On May 20, 2025, Gov. Ron DeSantis signed SB 944, which shortens the lookback period for insurers and HMOs to submit claims for overpayments to psychologists from 30 months to 12 months. The legislation aligns the lookback period for such overpayments with the lookback period required for claims for overpayments to physicians, podiatrists, dentists, and chiropractors. The legislation applies to claims for services provided on or after January 1, 2026.
For fully insured plans, carriers will be responsible for ensuring their overpayment recovery practices comply with the legislation. The law generally does not apply to self-insured plans; however, fiduciaries of plans that are subject to ERISA have a preexisting duty to monitor the plan’s spending and protect plan assets, so they should already have plans in place to identify and recover overpayments within a reasonable time period.
