Maryland Requires Coverage of Scalp-Cooling Systems for Chemotherapy, Expands Access to Counseling Coverage

On April 14, 2026, Gov. Moore signed a pair of laws expanding coverage requirements for health insurers:

  • HB393/SB272 requires insurers that provide coverage for chemotherapy to also provide coverage for scalp cooling systems used to prevent or reduce hair loss in connection with chemotherapy to treat cancer. For the full text of HB393/SB272, please see this legislative text.
  • HB1094/SB910 requires insurers that provide benefits for certain counseling services to provide reimbursement for those services when provided by certain supervised interns and graduate students acting within the scope of their authorization. Specifically, insurers that cover services provided by licensed graduate professional counselors must reimburse the same services provided by graduate-level counseling clinical interns acting under proper supervision. Similarly, insurers that cover services provided by licensed master social workers must reimburse services provided by a graduate-level social work clinical intern acting under proper supervision. Likewise, insurers that cover services provided by licensed psychologists must reimburse services provided by a graduate-level psychology clinical intern acting under proper supervision. Both laws apply to fully insured group health plans issued, delivered, or renewed in Maryland on or after January 1, 2027. Employers that sponsor fully insured group health plans in Maryland should consult with their carriers and amend their plans as necessary to conform to the new legislation. ERISA self-insured group health plans are generally exempt from state insurance laws.
